They are protected by the Copyright Act and related rights, and any use of content from the Website, without the consent of PowerLocus, is a violation of the law, which may result in civil, administrative and/or criminal liability. The Website is the protected subject of copyright and related rights and contains the subject of such rights.

3.2. The Website and the product contains information, materials, features, and other content that constitute copyrighted and related rights and contains such objects as trademarks, logos, trademarks, product and service names, and other similar protected objects of rights.

3.3. In the case of copying and/or reproduction of information beyond what is permissible, as well as in case of any other violation of intellectual property rights on the resources of PowerLocus, PowerLocus has the right to claim compensation for direct and indirect damages suffered in full.

For any violation under this article, the relevant user assumes all liability – civil, administrative and/or criminal, and the payment of compensation imposed by a competent authority to the affected persons.

1. LIMITATION OF LIABILITY

4.1. PowerLocus takes the necessary measures to keep the content of the Website up-to-date, but is not responsible for the actual up-to-date of the same. In this regard, PowerLocus is not responsible for damages, including direct and/or indirect damages, including lost profits, that a user of the Website would suffer under any circumstances related to the published content of the Website and access to it. By using the Website, users assume all risks associated therewith, including any risk to users’ end devices, software and/or data.

4.2. To the extent that the content of the Website contains links to content located outside the same, the user is aware of the fact that PowerLocus has no control over the same and is not responsible for the consequences of activating links leading outside the Website.

4.4. PowerLocus is not responsible for malicious actions by third parties, to which the user could become subject, when using the Website. The user uses the Website at his own risk.

4.5 PowerLocus is not responsible for any losses, direct, indirect and/or consequential damages and lost profits, because of and/or in connection with the use of the Website and/or the temporary inability to access/use the Website.

4.6. PowerLocus assumes no responsibility for the content or the way in which PowerLocus external sites and providers use your personal data. When visiting any of these sites, the user does so entirely at their own risk.

4.7. Any advice provided on this website or from the products user interface, should not be considered professional advice in any way. The Provider hereby disclaims all conditions, representations and warranties, express or implied, regarding accuracy, suitability, quality, fitness for a particular purpose, merchantability, non-infringement and/or non-interference with respect to its content, materials, programs, services and software.

4.8. The Products and all services provided shall only be used for lawful purposes. Any use of the Product, including recording, copying, publishing, reproduction, distribution, broadcasting, transmission and/or retransmission over an electronic communications network, publication on the Internet, public display, processing and/or use in any other way, outside of those specified in these General Terms and Conditions, can only be done with the express permission of PowerLocus.

 

1. V. WARRANTIES

5.1. All of our products sold website are covered by warranty conditions, in accordance with the law and the manufacturer’s commercial policies – 24 months from the date of purchase. To activate the warranty, the product must be registered in the specified section at https://powerlocus.com/ . In the event of a defective product, please send us an email to [email protected], which must contain your order number, accompanied by the reason for requesting a warranty procedure.

5.2. Defective products are accepted at the company’s service center, with delivery at our expense. The measures for implementing the warranty may be product repair, partial or full replacement and refund of the amount for the product, if no other solution is possible. In all the above cases, the maximum period for implementing the warranty is 30 days. Once the product is in working order, the customer will be notified and can pick up their goods from our service center or receive them by courier, at our expense. Shipment by courier of the finished item to the customer is at the expense of PowerLocus.

5.3. All goods, sent as defective products, must be accompanied by the original warranty card and payment document. The consumer is obliged to return the product in a commercial form that allows its subsequent sale as new. The unpacking of the product should not have resulted in a violation of the commercial form of the product, which is obvious. In case of a violation of the commercial form of the product, the Supplier has the right at its discretion to refuse to accept withdrawal from the contract.

5.5. Customers can activate warranty, by informing us on the channels provided on the website, which must contain your order number, accompanied by the reason for requesting a warranty procedure.

 

1. VI. SECURITY

6.1. We care about the security of our users. While we work hard to keep your contents and account safe, PowerLocus cannot guarantee that unauthorized third parties won’t be able to defeat our security measures. We do ask you to keep your password secure. Please notify us immediately of any compromised or unauthorized use of your account. Please note: PowerLocus never asks for your password by email or by any format other than the standard login window of our application!

6.2. If we notice strange activity on your user account, we may freeze your account until situation is clarified. Strange activity includes actions like logins from unusual locations, many logins attempts within a short period of time, deviation from deposit/cashout patterns or any other suspicious behavior. In this case, please check your email address registered with us or contact us via the contact form and follow our instructions.

 

VII. PROTECTION OF PERSONAL DATA

7.1. The Provider takes measures to protect the User’s personal data in accordance with the Personal Data Protection Act. For reasons of security of the User’s personal data, the Provider will send the data only to an e-mail address that has been specified by the User. The Provider has the right to store data in the User’s terminal communication device, unless the latter expressly expresses his disagreement thereto. The User agrees that the Provider has the right to send electronic messages to the User at any time, including a newsletter or offers to purchase goods. The User agrees that the Provider has the right to collect, store and process data about the User’s or the User’s behavior when using the Provider’s e-shop.

7.2. At any time, the Provider has the right to require the User to identify himself and to certify the authenticity of each of the circumstances and personal data declared by the User.

7.3. The processing of personal data that identifies individuals (including name, address, telephone number, e-mail address, workplace data, position, etc.) exchanged between them during and/or in connection with the performance of the Contract will be carried out in accordance with the requirements of Regulation (EU) 2016/679 of the European Parliament and of the Council on the protection of individuals with regard to the processing of personal data and on the free movement of such data and the applicable Bulgarian legislation.

7.4. The processing of data is carried out in strict compliance with the requirements of the applicable legislation only for the purposes of concluding and performing this contract, as well as for the protection of the legitimate interests of the parties thereto, in the event of non-performance.

VIII. OTHERS

8.1. PowerLocus reserves the right to amend these General Terms and Conditions at any time and at any moment the current terms of use of the Website will be published on the same.
